The Workplace Relations Commission directed Waterford City and County Council to pay firefighter Matthew Runciman €1,000 compensation and change how it calculates his public-holiday pay. Adjudication Officer Maria Kelly dated the decision 10 June 2022.
Runciman also complained about his paternity-leave pay. The WRC found he received the benefits due under the Paternity Leave and Benefit Act 2016, while the council’s top-up arrangement was outside the Act’s scope.
The public-holiday complaint concerned pay when Runciman was rostered off on a holiday. The WRC found regular Sunday and night premiums had to be included because they were fixed allowances. It said overtime, variable Saturday payments and night-meal allowances did not have to be included. The council was directed to use the required calculation and pay compensation for the breach.
