The Workplace Relations Commission found that motor mechanic Shane Barry was unfairly dismissed by Jordan Motors Limited Martin Barrett Car Sales and awarded him €17,472 for financial loss. The decision was dated 20 June 2022.
Barry was dismissed after being accused of failing to carry out safety checks on a car. The WRC found the employer failed to follow fair procedures: Barry was called to a meeting without prior warning or an opportunity to be represented, and there was no evidence of an investigation into the allegations or inspection of the vehicle.
The award reflected his financial loss after 28 weeks out of work and his move into lower-paid employment. He had earned €624 gross per week in his former job.
