Cork City Council wins WRC discrimination case over social housing

The Workplace Relations Commission found that Timmy McCarthy had not established discrimination in his bid for social housing through Cork City Council’s Choice Based Letting system. The decision was dated 15 November 2022.

McCarthy argued that inaccurate housing-list records and the Council’s handling of his family’s application disadvantaged them as Travellers. The Council denied discrimination and said the bungalow was allocated according to housing need and priority.

The adjudication officer identified serious administrative and communication failures, including inaccurate records and an unanswered complaint form. But the family who received the bungalow also belonged to the Traveller community, so the officer found McCarthy had not shown less favourable treatment on that ground. The complaint was not well founded under the Equal Status Acts.
