The Workplace Relations Commission found that Martin Kelly was not discriminated against on disability grounds after staff refused to serve him without a face covering. The decision, dated 27 June 2022, concerned his complaint against Dpl Group Ltd Dpl Group.
Kelly said a doctor’s letter exempted him from wearing a mask. The company said its policy required customers to wear a mask or face shield, and that phone-in collection was available.
The adjudication officer found Kelly had not provided evidence to establish a disability or shown that he was treated less favourably because of one. The complaint was not well founded.
