The Workplace Relations Commission dismissed Dorin Dusa’s disability discrimination complaint against Heatons Unlimited Company over an encounter with a security officer at a Dublin store. The decision was dated 17 June 2022.
Dusa said he was discriminated against when challenged for not wearing a face covering. The officer found that Dusa did not tell the security officer he had a disability that exempted him from wearing one. Dusa had a mask with him but preferred not to wear it.
The officer also found that Dusa was eventually allowed into the store and was not denied its goods or services. Under the Equal Status Act, a complainant must first establish facts from which discrimination could be inferred. The WRC found Dusa had not established those facts and dismissed the complaint.
