The Workplace Relations Commission found KDA Accountants unfairly dismissed Junaid Altaf and directed the firm to pay him €7,000 compensation. The decision was dated 15 June 2022. The adjudicator found the dismissal process lacked basic fairness, including adequate warnings and an appeal.

Altaf said he was dismissed after seeking a salary increase; the firm said it acted because of persistent underperformance. The adjudicator found the performance concerns arose before Altaf sought the increase, and did not find that request was the reason for his dismissal.

The adjudicator found the firm did not follow its disciplinary procedures or provide fair procedures at the dismissal meeting. Altaf was not told in advance that dismissal was a possible outcome, his right to be accompanied was disregarded, and he was not offered an appeal.

The WRC recorded Altaf’s loss at €18,956 and considered his efforts to find other work when setting compensation. It found the evidence did not show that he spent sufficient time seeking alternative employment, and awarded €7,000 in compensation.
