The Workplace Relations Commission found Nessa Coffey was not unfairly dismissed by Kentz Management Ltd and disallowed her two redundancy complaints. The decision was dated 16 September 2022. Coffey worked as an FP&A Manager until her role was made redundant on 4 April 2020. She said other employees received extra ex gratia redundancy payments and she did not, and argued that the company had not properly assessed staffing needs before making her redundant. Kentz said it had paid no ex gratia redundancy payments in Ireland since 2017 and that Coffey had received her statutory entitlement. The adjudicator found that Coffey had received the statutory redundancy payment due to her. On the unfair dismissal complaint, the WRC found her role was made redundant on genuine grounds. The adjudicator also noted that Coffey had not applied for available roles and found no evidence of a poor process or an intention to terminate her specifically.
