Adrian Ryan wins redundancy lump-sum entitlement

Adrian Ryan is entitled to a statutory redundancy lump sum based on weekly wages of €480 and continuous service from 28 October 2003 until his formal dismissal by AB Wood Products Limited, in Liquidation. The Workplace Relations Commission decision was dated 9 March 2022. Ryan said he expected to return to his dispatch-driver job after a fire destroyed the Ballylanders factory in 2018. The liquidator argued that a P45 suggested his employment had ended after the fire, and that all employees were made redundant when the company entered liquidation. The adjudication officer found Ryan had neither resigned nor been dismissed before liquidation. His application to the respondent on 1 July 2020 was within the 52-week time limit.
