The Workplace Relations Commission found Milan Professional Limited unfairly dismissed Zita O’Neill and awarded her €10,891 in compensation. The decision was dated 1 November 2022.
O’Neill said she was dismissed by phone without a fair chance to answer allegations. The company said the dismissal followed alleged misconduct at work and that she did not take up an offered appeal.
The adjudicator found the disciplinary process unfair, including because O’Neill had no opportunity to state her case or have representation. The commission also awarded her €907.63 for unpaid suspension wages and €907.63 for lack of notice.
