The WRC found that Palomar Ltd T/A McSwiggans unfairly dismissed Lorraine Manton by failing to properly consider alternative work before making her redundant. It awarded her €8,538.36 compensation and €4,269.18 for six weeks’ statutory notice pay in a decision dated 24 May 2022. Manton had worked as an office worker since 2006. She said she was not offered work in Dublin or alternative hospitality duties in Galway. The company said it closed the Galway office and that Dublin travel and hospitality roles were unsuitable. The adjudication officer found the company had not shown that it explored alternatives, including front-of-house work or office duties, or provided an appeal process. Her separate redundancy-pay complaint was withdrawn after she acknowledged receiving her full statutory entitlement.
