The WRC found it had no jurisdiction to hear Joseph Clarke’s two redundancy complaints against James C Byrne Manufacturing Limited Byrnes Jewellers because the company had been dissolved. The merits were not decided. In a decision dated 29 June 2021, adjudication officer Conor Stokes said a dissolved company no longer has legal existence and cannot be a respondent in employment proceedings. Both sides confirmed the dissolution, and the Companies Registration Office still listed the company as dissolved at the hearing. Clarke had worked for the company for 58 years. The decision said he may wish to contact the Department of Social Protection’s Redundancy Payments Section.
