WRC orders MCR Outsourcing to pay Arunas Joksas €2,038.75

The WRC found MCR Outsourcing Limited breached the Payment of Wages Act by failing to pay Arunas Joksas his full contracted weekly wage, and ordered the company to pay him €2,038.75. The decision was dated 20 April 2021. Joksas’s contract provided for 39 hours’ pay a week even when fewer hours were worked. The WRC found this guarantee had become part of his contract through custom and practice, supported by wage slips from a previous employer. His hours fell to 32 a week after his employment transferred to MCR Outsourcing in January 2019. The company did not attend the hearing, but the WRC decided the complaint on its merits. It found that the company had also failed to follow an earlier WRC determination requiring it to pay Joksas for 39 hours when fewer were available.
