The Workplace Relations Commission ordered MCR Outsourcing Limited to pay security officer Vygantas Stirbys €2,038.75 for unpaid wages. Adjudication Officer Jim Dolan found his complaint well founded in a decision dated 22 April 2021. Stirbys said a guarantee of pay for 39 hours a week continued after his employment transferred to MCR, even when he worked fewer hours. MCR paid him for 32 hours a week after his hours were reduced. The company did not attend the hearing. Dolan found that the 39-hour guarantee had become part of Stirbys’s contract through established custom and practice, supported by earlier wage records. The award covered 25 weeks between a January 2020 hearing on an earlier transfer case and Stirbys’s redundancy in July 2020.
