The WRC found Eddie Byrne’s constructive dismissal complaint against Secto Services Limited was not well founded. A separate minimum-notice complaint also failed. The decision was dated 19 August 2021. Byrne said he resigned under pressure over a proposed transfer of work to SK Utilities, then tried to withdraw his resignation when the transfer did not proceed as expected. Secto Services said he had resigned voluntarily to take another job and had worked and been paid for his notice. The adjudication officer found no evidence that Byrne had been pressured to resign. The officer also found that Secto Services was not obliged to accept his request to withdraw his resignation, made almost four weeks later. His minimum-notice complaint failed because he resigned and had worked and been paid for more than the statutory minimum notice period.
