The Workplace Relations Commission found Catherine Riordan was not unfairly dismissed by Wincanton Ireland Ltd, and her minimum notice complaint was also not well founded. The decision was dated 20 October 2021. Riordan challenged her dismissal for gross misconduct, disputing allegations that she bullied a colleague and raising concerns about the investigation and disciplinary process. Wincanton said its investigation upheld the allegations and defended its disciplinary and appeal procedures. The adjudication officer found the employer had a reasonable basis for dismissing her under its policy, which treated bullying as misconduct that could lead to summary dismissal. Although the officer noted concerns about aspects of the process, the appeal was considered thorough enough to address them, and the dismissal was found substantively and procedurally fair.
