The Workplace Relations Commission awarded Francis Corrigan €45,000 after finding he was unfairly dismissed by One51 Es Plastics Ltd Protech. The decision was dated 5 May 2023.
Corrigan said his redundancy was a fait accompli, with no proper consultation, alternative roles or appeal. The company said financial difficulties led it to restructure and transfer his product development work to Quebec. The adjudicator accepted the company faced genuine financial challenges but found it had not shown Corrigan was fairly selected for redundancy or given fair procedures.
The WRC found his Payment of Wages complaint about an unpaid bonus not well founded, concluding the bonus was discretionary and not wages properly payable. A second Payment of Wages complaint was withdrawn. The €45,000 compensation excluded the bonus and statutory redundancy payment.
