The Workplace Relations Commission directed Whw Brothers Focus Limited Colossus Casino to pay Elena Gabriela Tarnauceanu Ilinca €3,180 in statutory redundancy, subject to her having been in insurable employment during the relevant period. It also directed €1,388 compensation for failure to consult over a collective redundancy, €694 in lieu of notice and €277.60 for four public holidays. The decision by Adjudication Officer Brian Dalton was dated 16 November 2021. The casino closed during the pandemic and later ceased trading. The company told the WRC it was insolvent, had incurred several hundred thousand euros in losses and had no funds to pay redundancy. The officer found the employer had not consulted before the collective redundancy affecting about 30 employees. A second redundancy complaint was dealt with under the first.
