The Workplace Relations Commission found that Tarpey Maloney Properties discriminated against Eduard Biryukov on the housing assistance ground and ordered it to pay him €4,000. It also ordered training for relevant employees on the law affecting HAP applicants. The decision was dated 26 November 2021.
Biryukov said the rental application form required an employment reference without saying HAP or social welfare could show ability to pay. The company denied discrimination and said it had not received a completed application. The adjudication officer found that the form required employment details to secure a viewing, despite an accompanying email saying HAP was accepted. The company did not rebut the resulting inference of discrimination. The finding concerned the August 2020 incident; earlier alleged incidents were out of time.
