The WRC found David Walsh was unfairly dismissed by Bathshack IE Ltd T/A Bathshack and ordered the company to pay him €3,000. The decision was dated 25 January 2022. Walsh said he was unfairly selected for redundancy. The adjudication officer accepted that falling sales during the pandemic had created a genuine redundancy situation, but found Bathshack had not shown it carried out a fair, constructive or transparent consultation. The officer said the process did not include constructive engagement with Walsh or an exploration of ways to avoid his dismissal, and found the approach arbitrary and unreasonable. The officer found that Walsh was dismissed on 29 October 2020, when a business manager told him his job was gone, and concluded that his complaint had been submitted in time. Walsh said he had found higher-paid work that required him to move to Dublin in March 2021 and had tried to limit his losses. The WRC ordered Bathshack to pay €3,000 compensation.
