The Workplace Relations Commission found that Slidville Ltd t/a The Ashbourne Court Hotel did not discriminate against chef Marcus Flanagan or harass him. The decision, dated 14 June 2022, said the complaint failed.
Flanagan said his hours and pay changed after the hotel reopened following the first Covid shutdown, and that he received a written warning about clocking in and out. The hotel said business was under pressure, hours were reduced across the workforce and it needed another chef during Flanagan’s sick leave. The adjudicator found the evidence did not establish discrimination on a protected ground. The decision also said the evidence did not support harassment and that an October exchange did not meet the legal standard. The civil-status ground was withdrawn during the hearing.
