The Workplace Relations Commission rejected Nester Changunda’s complaints of age and race discrimination and constructive unfair dismissal against Cowper Care Centre Dac. The decision was dated 15 June 2022.
Changunda, a staff nurse, said she was discriminated against over promotional opportunities and that the treatment led her to resign. The centre denied discrimination and said promotion decisions reflected candidates’ suitability and familiarity with the workplace.
The adjudication officer found Changunda had not established facts from which discrimination could be inferred. On her dismissal complaint, the officer found she had not shown that she had no option but to resign and had not acted reasonably by failing to use the workplace grievance procedures before leaving. Both complaints failed on their merits.
