The Workplace Relations Commission awarded Vincent Fallon €4,000 after finding G4S Secure Solutions (Ire) Ltd underpaid him for holidays accrued during illness. The decision was dated 27 July 2021. The award included €3,256.68 in arrears of pay and €743.32 for breach of a statutory right. The adjudicator found Fallon was entitled to payment for 45 days of untaken statutory leave across 2018, 2019 and 2020. Regular, predictable overtime had to be included in the holiday pay calculation, along with his allowances. Fallon had received €3,218.10, leaving a €3,256.68 shortfall. His duplicate Payment of Wages Act complaint was subsumed, with no separate award. G4S argued that the holiday entitlement was limited to leave accrued in the 15 months before Fallon’s employment ended, and disputed including overtime. The officer accepted reasonable cause for a 10-day filing delay and extended the time limit.
