The Workplace Relations Commission awarded Warren Sweeney €5,400 after finding he was discriminated against because of his disability and was discriminatorily dismissed when he was prevented from starting work. The decision was dated 27 April 2022.
Sweeney, a mechanical fitter, said the site manager told him he could not start because he was diabetic. Msl Engineering said the decision followed an induction incident and that his diabetes was not a factor. The adjudicator found the evidence showed diabetes had been mentioned as a reason he was not allowed to start. The WRC ordered €5,400 compensation for the effects of the discrimination, approximately six weeks’ wages; it was compensation, not pay owed.
