The Workplace Relations Commission found Olive Hogarty’s complaints against Gerry Rafter, The Rafter's Gastro Bar/the Rafter Dempsey's, not well founded. The decision was dated 22 November 2022. Hogarty said her hours were cut after she returned to work, her duties expanded and the working environment led her to resign after nearly 22 years. The WRC rejected her banded-hours complaint, finding she had not made the required application and had averaged 30 hours after returning. It also found her duties had remained largely unchanged, and that she had not met the required standard to prove constructive dismissal. The respondent said there had been no written request for banded hours, no material change to her duties and insufficient evidence for the constructive dismissal claim.
