WRC rejects redundancy and notice claims against Ryan's Investments

The Workplace Relations Commission rejected Pawel Mokwinski’s redundancy and notice claims against Ryan's Investments Unlimited Company, finding he had resigned after taking courier work and returning his uniform. In a decision dated 24 September 2021, the adjudication officer found there had been no dismissal and no valid redundancy. Mokwinski said he believed his employment had ended after seeing a cessation entry on Revenue’s website and sought a redundancy payment and pay in lieu of notice. The company said he had been temporarily laid off during the pandemic and chose to leave after finding other work. The WRC found both claims not well founded; the notice claim failed because he had resigned and no notice payment was due.
