The Workplace Relations Commission awarded Gerard Buston €12,660 after finding that Duggan Systems Limited unfairly dismissed him. The decision was dated 8 April 2022.

Buston said he was selected for redundancy after a heated exchange with a manager. He argued there was no consultation, notice or proper consideration of alternatives. Duggan Systems said the Covid-19 pandemic had sharply reduced its business and it needed to cut its workforce.

The WRC found that the redundancy was a sham, noting the arguments immediately before the dismissal and the lack of consultation, notice or exploration of alternatives. It awarded €12,660, equivalent to 20 weeks’ gross pay.
