The Workplace Relations Commission found Ian Hales was unfairly dismissed by Dallen & Co Mechanical Services Limited Dallen Mechanical and directed the company to pay €6,996 compensation. It also found his minimum-notice complaint well founded and directed payment of €2,332. The decision was dated 16 August 2021. Hales said he was dismissed after raising concerns about the quality of welding on a client project. The company did not attend the hearing, and the adjudicator relied on Hales’s uncontested evidence. The adjudicator found Hales had no fair opportunity to respond to concerns about his work and that the dismissal was procedurally flawed. Hales returned to work within six weeks.
WRC awards Ian Hales €6,996 for unfair dismissal and €2,332 in notice
