The Workplace Relations Commission found Andzelika Ali was unfairly dismissed by Mark Jones t/a Spar Carpenterstown and awarded her €2,100 compensation. It also awarded her €2,529.36 for the employer’s failure to give statutory notice. The WRC, in a decision dated 10 June 2022, found Ali had taken Covid-related leave with her manager’s permission and had not resigned. The adjudicator said the employer gave no evidence to justify the dismissal. Ali had worked as a supervisor, and her employment ended after the employer refused to let her return. The adjudicator found Ali had not made sufficient efforts to reduce her financial loss, and awarded five weeks’ compensation for unfair dismissal. The separate notice award was six weeks’ pay.
