The Workplace Relations Commission found that landlord Tom McElroy did not engage in prohibited conduct in a complaint brought by tenant Sarah Biyela. The decision was dated 14 June 2022.
Biyela said McElroy refused to complete Housing Assistance Payment forms and told her to find another place to rent. She also alleged discrimination on disability and Housing Assistance grounds, and victimisation. McElroy said he had not received an application to complete the forms and no longer wanted to rent the property because repairs were needed. The adjudicator found Biyela had not established less favourable treatment linked to disability, or that she belonged to a qualifying household for Housing Assistance or linked the alleged treatment to that ground.
