The Workplace Relations Commission found that landlord Tom McElroy did not engage in prohibited conduct in a tenant’s complaint about disability and Housing Assistance discrimination. The decision, dated 14 June 2022, concerned Sipho Biyela’s complaint against McElroy under the Equal Status Act.

Biyela said McElroy refused to complete Housing Assistance Payment forms and told the tenants to find another place to rent. McElroy said he had not been told about a disability and had not received an application form.

The adjudication officer found no evidence that Biyela had been treated less favourably because of disability or that any alleged treatment was linked to that ground. Biyela had not provided documentation showing that he qualified for Housing Assistance or evidence that the forms had been delivered to McElroy. The officer was therefore not satisfied that Biyela had established a link to the housing assistance ground. The WRC found that McElroy had not engaged in prohibited conduct.
