The Workplace Relations Commission found two complaints by Shay O’Hare against Swissport Ireland Limited not well founded. O’Hare said he had not been notified in writing of a change to his employment terms and that wages were unlawfully withheld during lay-off. The adjudicator found O’Hare’s contract allowed lay-off without pay, so no change requiring written notice had occurred. The adjudicator also found Swissport’s manager exercised the lay-off discretion reasonably and no wages properly payable to O’Hare had been unlawfully deducted. The decision was dated 30 June 2022.
