The Workplace Relations Commission found Abbott Laboratories Ireland Limited did not discriminate against Grzegorz Chrymecki and that his dismissal was not unfair. The decision was dated 8 April 2022. The WRC also recorded that Chrymecki’s equality complaint concerning his dismissal had been withdrawn.
Chrymecki, a production operator, said Abbott failed to accommodate his disability. Abbott said it assessed possible adjustments and other production roles, but found none that would allow him to carry out the work. The adjudicator accepted that Chrymecki had a physical disability and found that Abbott had conducted a detailed assessment. The decision said his required breaks and reduced output affected the continuous production operation, and found no reasonable accommodation would allow him to continue in his role.
The adjudicator found the remaining disability discrimination complaint was not made out. The WRC also found the dismissal was not unfair, concluding that Chrymecki was incapable of performing the work for which he was employed and that his employment contract had become frustrated. Both decided complaints failed, and no compensation was ordered.
