The Workplace Relations Commission awarded Tatiana Kobzeva €2,520 in compensation after finding that Athlunkard Nursing Home Limited unfairly dismissed her. The decision was dated 4 November 2022. Kobzeva worked as a healthcare assistant. She said the nursing home ended her employment in correspondence dated 8 June 2020, after she sought to return from leave. The home denied dismissing her and said her previous role was temporarily unavailable, before offering her work under a revised roster. The WRC found that the message saying her previous job was no longer available communicated that her employment had ended. It found the dismissal was summary and without procedure, making it unfair. The compensation was equivalent to eight weeks’ remuneration. A second unfair-dismissal complaint was not well founded because the WRC found it duplicated the first complaint.
