WRC upholds Ruta Birnika’s redundancy payment claim

The WRC upheld Ruta Birnika’s complaint against Ballyleague Mushrooms Ltd, finding she was entitled to a statutory redundancy payment based on her service from 5 April 2006 to 14 February 2020 and gross weekly pay of €262. The decision was dated 19 January 2022. Birnika worked as a mushroom harvester. The company argued that it had offered her alternative work, including a return to the Ballyleague plant, but the adjudicator found the other farms were 70 to 75 kilometres away and the return offer came outside the statutory time limit.
