WRC declines jurisdiction over Gabriel McCabe's €11,272 bonus claim

The Workplace Relations Commission declined jurisdiction over Gabriel McCabe’s claim for an unpaid €11,272 bonus from AB Group Packaging Ireland Ltd; the merits were not decided. The decision was dated 27 October 2021. McCabe said his contract entitled him to a profit share and that the company had underpaid his bonus. The company argued that a severance agreement barred the claim. The adjudication officer found that the agreement compromised McCabe’s claims under the Payment of Wages Act 1991. The WRC therefore had no jurisdiction to inquire into the complaint.
