The Workplace Relations Commission awarded Lisa Burke €350 after finding a technical breach of employment terms law at Atk Community Centre Company Limited by Guarantee t/a St. Kierans Community Centre. Its decision was dated 31 May 2022. Burke, a childcare manager, said she had no reasonable option but to resign after raising concerns about staffing, compliance and management. The Centre said she had not been forced to leave and had resigned to take another childcare job. The WRC rejected her constructive dismissal complaint, finding the evidence did not establish a fundamental breach of contract or sufficiently unreasonable behaviour to make resignation her only option. It upheld her separate complaint over the terms provided for her manager appointment: her contract was mistakenly marked fixed term although it was intended to be permanent. The officer found that this was a technical breach and awarded €350 compensation for breach of a statutory right.
