The Workplace Relations Commission found Lynda McMonagle’s complaint against Tesco Ireland Limited over changes to her working hours was not well founded. Two other complaints were withdrawn. The decision was dated 29 November 2021. McMonagle, who began work as a general assistant in 2002, argued Tesco was changing a long-standing work pattern that had been recorded as protected in 2010. Tesco relied on her contract, which allowed variable start and finish times and hours over up to five days. The officer found the proposed shift changes did not alter the particulars in the only signed and dated employment statement provided under the Terms of Employment (Information) Act.
