The Workplace Relations Commission awarded Caitríona Ní Cheallaigh €8,960 after finding her constructively dismissed by Donegal Travellers Project (Limited by Guarantee). The decision, dated 10 June 2022, also found two complaints outside the time limits, with the merits not decided, and recorded two other complaints as withdrawn.
Ní Cheallaigh resigned in February 2020 after a grievance process following workplace and pay concerns. The WRC found that the appeal of her grievance was manifestly unfair. The appeal officer had work and family connections to people involved in her grievances, creating a perception of bias, and the adjudicator found it was reasonable for her to resign.
The respondent said its limited resources constrained the appeal arrangements. The WRC awarded four months’ lost salary and made no contribution reduction to the compensation.
