The Workplace Relations Commission found that Annix Software Limited trading as Quest Systems discriminated against Brian Kiernan and awarded him €58,000 compensation. The decision was dated 19 July 2022.
Kiernan, a technical support manager who had worked for the company since 1999, complained that it failed to accommodate his back injury and subjected him to victimisation and harassment. The respondent denied discrimination.
The adjudicator found the employer used Kiernan’s disability to block his return to work and left him with no alternative but to resign. His complaint was upheld as discriminatory dismissal. The €58,000 award was compensation for the effects of the discrimination.
