The WRC found a sales representative’s complaint over a €15,273.73 deduction from redundancy pay was outside its jurisdiction, while a second complaint about the amount paid was not well founded. The decision was dated 14 April 2021. The worker said he was not told about the deduction seven days in advance, had not agreed to it and it was not provided for in the severance agreement. The company argued that redundancy payments were not wages under the Payment of Wages Act and that the agreement waived claims. The WRC found the deduction came from an ex gratia redundancy payment, which is not wages under the Act. The separate complaint failed because the worker had received all wages due.
