Mariann Bodor was awarded €8,221 in compensation after the Workplace Relations Commission found she had been unfairly dismissed through an unfair redundancy selection. The decision was dated 4 May 2023.
The WRC found iNUA Hospitality Group t/a Radisson Blu Hotel & Spa did not act fairly or reasonably in selecting Bodor for redundancy. It had not prepared a selection matrix, and her position appeared to have been singled out. A last-minute offer of an Accommodation Assistant role would have put her in a lower position than she held immediately before the redundancy.
Bodor said her dismissal followed a grievance about her supervisor and claimed penalisation. The hotel said reduced business during the Covid pandemic led to the redundancy and denied penalising her. The WRC found the grievance did not refer to any of the nine grounds protected by equality law, so her penalisation complaint was not well founded. The unfair dismissal complaint succeeded because of the way the redundancy selection was handled.
