The Workplace Relations Commission found that Ian Nagle was unfairly dismissed by Premier Auto Parts Ltd and awarded him €3,464. It also awarded him €1,732 after the company conceded it had not provided written employment terms. The decision was dated 28 October 2021. Nagle had worked for the company since 1995 and was its Sales Manager when his employment ended in July 2020. The company said falling sales required cost reductions and denied unfair selection. The WRC found there was a genuine redundancy, but Nagle was selected solely because of his high salary, without a fair process or proper consideration of alternatives. It found that he had mitigated his financial loss. Two complaints under the Organisation of Working Time Act were withdrawn.
