The WRC awarded Sally McCormack €4,000 for unfair dismissal and €400 for the failure to provide written employment terms. The decision was dated 20 September 2021. McCormack said she was the only staff member dismissed when the shop reduced staffing after the Covid-19 closure. Marie Conneely, t/a No 58, said the business had been badly affected and that McCormack mainly worked Sundays, which could be covered by other staff or Conneely herself. The officer found there had been no consultation or objective selection criteria before McCormack was selected for redundancy. The two successful complaints concerned the missing written terms and unfair dismissal. Her duplicate unfair-dismissal complaint and equality complaint were withdrawn; the health and safety penalisation and minimum-notice complaints were not well founded. A separate minimum-notice complaint was not pursued because it had been made in error.
