The Workplace Relations Commission found Gary O’Flaherty entitled to a redundancy lump sum, subject to the stated employment and insurance criteria, and ordered Heneghan Premier Services Ltd to pay him €1,700, €896 and €200 on three other complaints. The decision was dated 8 June 2022.
O’Flaherty worked for the company from 1 October 2017 until 5 June 2020, when he was dismissed on grounds of redundancy. The adjudication proceeded in the respondent’s absence. The officer found that the permanent lay-off amounted to dismissal and that a redundancy situation arose. Starting another job while on lay-off did not, by itself, amount to resignation or remove his redundancy entitlement.
The officer also found that O’Flaherty had not received a statement of employment terms and awarded €1,700 redress. He was entitled to two weeks’ notice pay after an immediate dismissal without paid notice, resulting in €896, and was owed two days of annual leave, for which the officer awarded €200.
