The Workplace Relations Commission rejected Joyce Owens’s claims of age and nationality discrimination, harassment and health and safety penalisation against Hope Autism Care Centre Limited t/a Hope Montessori & Autism Care Centre. The decision, dated 5 May 2022, also records that her employment permits complaint was withdrawn. Owens, a teacher, said she was criticised at work and felt excluded when Spanish colleagues spoke Spanish. The WRC found she had not established facts supporting an inference of discrimination or harassment. It also found her classroom noise concern was not an operative reason for placing her on garden leave during her notice period. Her penalisation complaint was not well founded.
