The Workplace Relations Commission awarded Kieran Murray €32,833.70 after finding that Sherry Garden Rooms Limited unfairly dismissed him. The decision was dated 8 April 2022.
The company said the dismissal followed pandemic-related restructuring and that consultation would not have changed the outcome. Murray said he was not consulted about alternatives, represented or given a chance to appeal.
Adjudication officer Kevin Baneham found there had been no process or consultation, no substantial grounds for dismissal and no genuine redundancy. The company was also directed to pay €1,961.52 for two weeks’ notice and €1,500 because Murray’s employment statement gave an inaccurate start date.
