WRC recommends fresh investigation into worker’s bullying complaint

The WRC recommended a new independent investigation into a former worker’s bullying complaint, with terms of reference and a process based on the Code of Practice on the Prevention and Resolution of Bullying at Work. The recommendation was dated 16 July 2021. The worker and Unite the Union said the employer investigated the complaint under a bullying policy they had not agreed to, instead of the Dignity at Work Policy. The employer said it was entitled to use its 2014 policy and was not required to agree policies with the union. The adjudication officer recommended that the worker’s complaint be investigated by a new external investigator. She said the status of company policies was outside the dispute referred to her.
