Cork County Council wins parking enforcement transfer claim

By Fionn Kelly

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found that Cork County Council did not have to take on Clive Jones when it brought parking enforcement in-house. The decision, dated 10 January 2022, found his complaint not well founded. Jones argued that the council should have taken on the employees of the contractor that had run the parking enforcement service. The council said the contract had expired and it combined parking enforcement with litter wardens in a new in-house service. The WRC found that no property, assets, goodwill or employees transferred to the council, so there was no transfer of an undertaking and the regulations did not apply.
