WRC finds Aija Galdika entitled to redundancy payment

The Workplace Relations Commission found Aija Galdika was entitled to a statutory redundancy payment after her position at Ballyleague Mushrooms LTD was made redundant. The decision was dated 22 October 2021. The company argued that a collective redundancy exception applied because replacement workers had inferior terms, and that Galdika had refused offers of alternative work and re-engagement. The adjudication officer found her dismissal arose from trading difficulties and that the company’s later resumption of business could not change the reason for it. The officer also rejected the alternative employment argument because the offer was made outside the statutory time frame. The payment is based on employment from 12 May 2006 to 14 February 2020 and gross weekly pay of €395.46, subject to Galdika having been in insurable employment during the relevant period.
