The Workplace Relations Commission awarded Marie Quinn €43,500 for unfair dismissal after finding that Fibreseal Stainguard Services Limited Fibreseal had terminated her employment without consulting her or exploring alternatives. The decision was dated 30 November 2021.
Quinn, a sales consultant, said she was dismissed under the guise of redundancy while continuing to seek customers. The company said it had intended to lay her off during the pandemic and expected her to return when business resumed. The officer found the termination letter clearly ended her employment and no consultation or alternatives were considered.
The WRC also awarded her €1,359.08 under the Payment of Wages Act and €6,692.31 for eight weeks’ notice. Her redundancy payment complaint was not well founded because the officer found this was not a redundancy situation. The awards were gross amounts and were payable within 42 days.
